MP defends right to record calls
MEMBER for Burnett Rob Messenger has defended his right to record his telephone conversations.
Late last week, state Transport Minister Annastacia Palaszczuk threatened to refer Mr Messenger to the Integrity, Ethics and Parliamentary Privileges Committee in parliament over a covertly taped phone call.
Mr Messenger had taped a call between himself and a Queensland Rail executive while discussing the company’s decision to move from a contract system of buying wooden sleepers to a tender system.
The Burnett MP is concerned the move will mean dozens of local timber cutters will lose work.
Ms Palaszczuk told parliament on Thursday she wanted to seek legal advice about the phone call before proceeding.
Mr Messenger told the NewsMail yesterday he had taped the phone call to ensure he had an accurate record of the conversation.
“The issue is one which involves potential corruption,” he said.
The QR executive was not made aware the phone call was being taped.
“I comply with the law,” Mr Messenger.
He said he taped phone calls that dealt with sensitive issues and potential corruption.
He also said people within both parties and government bodies had lied to him.
“I have to make sure that when they lie, I have a record,” he said.
Mr Messenger said he did not tape all his phone calls, but also did “not necessarily” tell people when they were being recorded.
Mr Messenger tabled advice from the parliamentary library on Friday that showed he was not in breach of any laws by recording the conversation.
“Under the Telecommunications (Interception) Act 1979 it is illegal for anyone other than law enforcement officers to record the contents of a telephone conversation with a device attached to the phone system,” the advice read.
The advice said a person who taped a phone conversation they were party to, using a device not connected to the telephone, were not in breach of telecommunications or privacy laws.
